Privacy policy
Gizbarit is a
cloud-based financial management system ("System") for small
businesses, consisting of a website ("Site") and a mobile application
("App").
To provide services through the Gizbarit
system, Vaikra AG Projects Ltd. ("Company"), the owner of the system,
uses the personal data of authorized users who manage their businesses through
the system, as well as information about users' clients that they enter the
system. This Privacy Policy details how and for what purposes we collect and
use personal data on the Site and App ("Privacy Policy").
"Personal data" means information
relating to an identified or identifiable individual or company (including
first and last name, company name, email address, identification number or
company number, and other contact information).
In addition to the information detailed below
in this Privacy Policy, our clients using the System may upload additional
information to the System, including specific commercial business information
and personal data about their clients and suppliers ("Client Proprietary
Information"). The type and scope of Client Proprietary Information, as
well as the purposes for which it is used, are determined solely by the client
and are their responsibility, and accordingly, this Privacy Policy does not
apply to Client Proprietary Information. Clients using the System are required
to use our System in accordance with applicable data protection laws and
regulations. We will use Client Proprietary Information to best provide our
services, with the exception of general and statistical information collected
in connection with the use of the System, which we use to manage the System and
improve our services, or information that we are required to retain for legal
protection or to comply with any law. Regulatory Status and Processing
Functions:
With respect to system users and the use of
information necessary for the functioning of the system's services, the Company
acts as an information controller. With respect to customer-owned information
(data from the customer's suppliers/partners), the Company acts as an
information processor, acting only in accordance with the customer's
instructions.
This Privacy Policy is worded in the masculine
gender for convenience only, but it applies equally to all users.
Terms of Use. This
Privacy Policy forms part of our Terms of Use ("Terms of Use"). Any
term not defined in the Privacy Policy will be interpreted in accordance with
the Terms of Use.
Consent and Policy Updates. You are not required to provide us with personal information and
hereby confirm that providing your personal information is done by your choice
and free will to use the system. However, please note that if you choose to use
the system, we will require identification and other data to verify your
identity, provide you with documents and reports, and for other purposes
detailed below.
By using the system, you agree to the Privacy
Policy and to any collection, processing, and transfer of personal information
for the purposes stated therein. If you do not agree to the terms of the
Privacy Policy, please refrain from using the system. We may change the Privacy
Policy at our discretion at any time, and your continued use of the system
constitutes your agreement to the latest terms of the Privacy Policy applicable
to such use.
Lawful grounds for processing: We will process
personal data only in one of the following cases: (1) processing is necessary
to provide the service and perform the agreement between us; (2) processing is
necessary to comply with legal obligations (including tax and accounting laws);
(3) you have given your explicit consent (e.g., to the use of optional cookies,
profiling, and direct marketing where required by law); (4) we have a
legitimate interest (service security, improvement, fraud prevention), subject
to the protection of your rights.
What personal data do we collect and how?
We receive and collect your personal data in
the following ways:
Contact details and the content of your
request. If you contact us through the website (e.g., via the "Contact
Us" form), by email, or by any other means, you will be asked to provide
us with certain information, such as your name, email address, etc. We will
also use any information you provide in the content of your request so that we
can process your request. Please refrain from providing confidential,
unnecessary, or personally identifiable information without their express
consent.
Completing registration, verification, and
creating an account. To register for the system
(including the trial period), you will be asked to create an account by
providing your information, such as your name, email address, company
identification number, company contact phone number, full name in Hebrew and
English, username, password, and more.
Information collected during use. As you use the services, you may provide us with, and/or we may
collect, additional personal information about you, such as your income
information.
Log files We may
use log files. Information contained in log files includes IP address, browser
type, date/time stamp, referring/exit pages, filtering activity, clickstream
data, and any other information your browser may provide to us. We may use this
information to analyze trends, administer the site, track user traffic on the
site, and gather demographic information.
Cookies and Similar Technologies. We may use cookies, anonymous identifiers, and other tracking
technologies for information security purposes, as well as to provide our
services, display personalized information, and improve your user experience. A
cookie is a small text file used, for example, to collect information about
website activity, store user preferences, and perform authentication. Some
cookies and other technologies may also collect personal information, such as
your IP address.
Mobile Device Data. We may collect limited information from your device for operational
purposes. This information may include the type of device you use to access the
site, your device identifier (ID), the date and time of your use of the site,
your browser type, your browser language, the date and time of your request,
and the URL you requested. We may also use location technologies to compile
aggregated statistics, but we will not use any personally identifiable
information for these purposes.
Analytics and Other Analytics Tools. The Site may use a tool called "Google Analytics" to
collect information about site usage. Google Analytics collects information
such as the frequency of user visits to the site, the pages you visit, and the
websites from which you linked to our site.
We use the information collected through
Google Analytics to maintain and improve the Site and our products. We do not
combine information collected through Google Analytics with personal data.
Google's use and sharing of information collected through Google Analytics
about your visits to and use of the Website is restricted by the Google
Analytics Terms of Service, available at
http://www.google.com/analytics/terms/us.html, and the Google Privacy Policy,
available at http://www.google.com/policies/privacy/. You can learn more about
how Google collects and processes data through Google Analytics at
http://www.google.com/policies/privacy/partners/. You can prevent Google
Analytics from using your data by downloading and installing the Google
Analytics Opt-out Browser Add-on, available at
https://tools.google.com/dlpage/gaoptout.
System support is
available via email and other means, including WhatsApp. We provide support and
maintenance through various methods and platforms. Any personal information you
provide through various channels, including our corporate WhatsApp, will be
stored and used for the purposes of providing services, providing support,
improving the system, understanding our customers' preferences, identifying
them, and ensuring service security.
Logs. We may use
log files in our system. Information contained in log files includes IP
address, browser type, date/time stamp, referring/exit pages, filtering
activity, clicks, and any other information your browser may provide to us. We
may use this information to analyze trends, manage services, track user traffic
within our services, and gather demographic information.
We use cookies in our system that are
necessary for operation and to improve the UI (user interface).
For what purposes do we use personal
information?
We will use personal information in accordance
with our Privacy Policy, in compliance with all laws, and for the purposes
detailed below:
1. To enable you to use the system and take
full advantage of its features;
2. To respond to and process your requests,
improve our service, system, and website, retain customers, and manage our
relationship with you;
3. For documentation, regulatory, and legal
compliance purposes;
4. For characterization, research,
advertising, and tailoring marketing content across various platforms.
5. In accordance with the law, we will use
your email address and any other means to send you marketing offers or
publications that we think may be of interest to you (including email and SMS),
as well as updates or news regarding our system, and tailor marketing content
as specified below. If you are no longer interested in receiving these
communications, you can unsubscribe at any time by clicking the unsubscribed
link displayed in marketing emails or by submitting a deletion request via the
contact page on the website.
Sharing Personal Information with Third
Parties
We will not share the information you provide
with third parties, except in the following cases:
1. With your consent or as necessary to
provide the service. For example, to service providers who help us store
information uploaded to the system, ensure information security, manage the
website, and develop certain tools available to you through the system and used
to analyze your business information. Such information may also be transferred
to providers in other countries, including the United States.
2. In the event of any dispute, claim,
lawsuit, demand, or proceeding, or if you violate the terms of use or privacy
policy, or if you commit any actions deemed unlawful, we may disclose
information to our consultants or anyone on their behalf to conduct necessary
investigations and resolve the matter.
3. To the extent disclosure is necessary to
prevent personal injury or property damage (to you or third parties) or in
connection with an investigation of suspected illegal activity.
4. When required by law to transfer your
personal information and information about your system activity to third
parties, including if the Company receives a court order requiring it to
transfer your information or information about you to a third party, or in
response to a request from law enforcement agencies or other government or
public authorities.
5. To the extent the Company transfers its
operations or a portion thereof to another corporation, it will have the right
to transfer information collected about you to such corporation, or in
connection with a change in corporate structure, the acquisition of the Company
or its assets, or investigations related to such events.
6. When you purchase goods and services from
our merchant and content partners, or when you participate in third-party
content-related activities, or in joint activities between the Company and a
third party featured on the Site. In these cases, these partners will be
provided with the information they need to complete the purchase process,
manage the related content activity, and maintain communications with you.
7. Transferring information necessary to
obtain an allocation number from the Tax Authority in accordance with the
"Israel Invoice" model.
Some processing may occur outside of Israel
(including the European Union and the United States); we will take appropriate
contractual and technical safeguards for these transfers in accordance with
applicable law.
Use of Anonymous Information. We may use anonymous information (which does not allow identification
of an individual user, such as aggregated statistical information about system
usage) or disclose it to third parties to improve the website or system and
service quality.
Links to Third-Party Products. The System may allow you to interact with your Third-Party Service
account and other third-party websites, including applications and services not
owned or controlled by us (each, a "Third-Party Service"). We are not
responsible for the privacy practices or content of Third-Party Services.
Please note that Third-Party Services may collect your personal information.
Therefore, we encourage you to review the terms and conditions and privacy
policies of each Third-Party Service you choose to use.
Security. The
Company implements advanced technological systems and information security
procedures that mitigate the risk of unauthorized access to the Company's
computers and information stored within the system or on the website. However,
despite our efforts to use high-quality means to protect your personal
information, we do not guarantee complete protection of the system from
unauthorized access. If you have any questions about the security of the
Service or your privacy, you can contact us through the website.
In the event of a security incident that may
compromise your privacy, we will notify users and the relevant authorities as
soon as possible and in accordance with the law.
Your Rights and Privacy Protection. We respect
the privacy rights of our customers and website visitors and are committed to
maintaining only necessary, current, and accurate information. It is important
to us that you have the right to review the information we store about you. If
you find that this information is incorrect, incomplete, unclear, or outdated,
you have the right to contact us with a detailed request to correct or delete
the information, in accordance with the provisions of the Personal Data Protection
Act No. 5741-1981. We invite you to contact us regarding this matter and any
questions regarding your privacy by providing the relevant contact information
on the contact page on the website. If you are a client of one of our clients
and have a question or request regarding information concerning you that forms
part of their business data, please contact them directly.
In addition to your statutory rights
(information access and correction), you may request the deletion of
information that is no longer required, restrict processing, object to
processing for marketing or analytical purposes, and receive a copy of the information
held about you ("data portability")—all in accordance with statutory
provisions.
Privacy Inquiry Channel: Inquiries regarding privacy and information rights are processed
through the contact form on the website. A response will be provided as quickly
as possible and in accordance with statutory provisions after verification of
the applicant's identity.
Most information can be viewed directly in the
system. Regarding accounting documents, adjustments are made in accordance with
statutory provisions (e.g., by issuing a credit document or creating a new
document instead of retroactively amending an existing document).
Children's Privacy.
Our various services are not intended for individuals under 18 years of age. We
do not collect personal information from children under 18, and if you are not
authorized to use the system, please refrain from doing so or from providing
any personal information about yourself.
However, users under 18 may open an account if
they meet legal requirements (including owning/operating a legitimate
business). If we become aware of information being collected in violation of
the law, we will take appropriate steps to delete it.
Information Retention and Deletion. We generally retain our customer information for the period necessary
to achieve the above purposes. If you would like to request deletion of
information uploaded to the system after 7 years, please contact us through the
system support section, and we will take reasonable steps to process your
request.
By default, the system is set to continuous
retention (without a time limit), but the customer can specify that data older
than 7 years be permanently deleted. "Regular" deletion removes data
from active databases; encrypted backups (e.g., in S3) may be retained for a
limited time for recovery and compliance purposes. Full deletion (including
backups) will only be performed upon explicit request via chat, after
explanation of the consequences and final customer approval.
Law and Jurisdiction. This privacy policy is governed exclusively by the laws of the State
of Israel, and the Tel Aviv court has exclusive jurisdiction over any claims
regarding this privacy policy.
If a final judgment or court order finds any
part of this Privacy Policy invalid, only that part will be invalidated, and
all other parts of this Privacy Policy will remain in effect.
Transfer of Information Outside of Israel:
Personal data may be stored or transferred to various countries (including the
European Union and the United States). We ensure an adequate level of
protection through appropriate contractual and technical measures in accordance
with applicable law.
Privacy Officer:
An internal Privacy and Information Security Officer has been appointed. You
can contact us regarding privacy and information rights via the in-system chat,
and a member of our team will process your request.
